This can relate to property and finance and health and welfare. A Power of Attorney can be crucial in many scenarios where an individual cannot personally tend to their affairs.

  • you may be going into hospital or care and need help with day-to-day requirements such as ensuring bills are paid
  • you are diagnosed with a condition that threatens your mental capacity such as dementia

In the event that a person loses capacity without having put an LPA in place an application to the court of protection for the appointment of a deputy will be required, the implications are:

  • the incapacitated individual has no say in who will be managing their affairs
  • the incapacitated individual’s assets cannot be accessed until a deputyship order is in place (including joint accounts)
  • the process of appointing a deputy is costly and time consuming, once set up, an annual fee is also payable
  • the deputy operates under stricter supervision subject to the oversight of the court of protection
